Tex India Mart is a service and trade market based website to offer custom prints and products. The passionate people offering designs and patterns through our website are our strength. We believe in teamwork and work with trust and faith with same expectation from our members & designers. We reserve the right to update, amend or replace any point of terms & conditions. Please check time to time for any amendment in terms.

After registration on the site, we will send you an email to acknowledge confirmation of your account. The password is created and you held responsibility to maintain confidentiality of the password including activities in your account. TIM will not held any liability for any loss / damage from your failure to comply with this section. You agree to immediately notify TIM of any Unauthorized / Suspicious / activity in your account.

Tex India Mart is service and trademarket based website that allows anyone to upload, display, print your designs, manufacturing of products with us. With automated flexibility to designers and members, TIM cannot review every content that is uploaded to the site. TIM shall hold rights in their sole discretion to review and reject or remove the content against violation of terms or objectionable content at any point of time. Any content of design available on the site must comply to the guidelines and compliance with the Terms and Conditions set forth in this terms.

TIM shall hold no responsibility for the origin of your creation or compilation of your content. You agree by posting content on TIM to display it public, other websites or parties may copy or re-post your content without limitation. At the same time, you agree to TIM for no harm in any dispute in such use. You agree to waive any claims against TIM and it’s employees, contractors or third party agents for any losses, damages against the material available after post on the site. You acknowledge and warrant for all information provided at the time of registration is accurate. In case of any change in the contact information, you shall immediately contact TIM for changes in the records.

Tex India Mart hold right to copy, modify, crop, reproduce, display your designs, contents or uploaded files worldwide. TIM will only perform this action whenever necessary to provide the site. By submitting content to or utilizing the site, you grant Tex India Mart a royalty free, non-exclusive, transferable right to modify, copy, sell, display, and distribute content or the goods created using the content.

You represent and warrant by uploading / submitting the content to the site that;

This is considered agreed between You and Tex India Mart that except for your content or any data/material including but not limited to just designs ,images, pictures or other material distribute on or through our website is proper protected by Trademark, Copyright, Patents or any other proprietary rights and laws shall belong to Tex India Mart. You must not use or distribute any content from the site without authorization of the owner of such content except lawfully permitted. You confirmed and agreed that the site and any software used that contains proprietary or confidential information that is protected by intellectual property and laws shall remain the property of Tex India Mart which cannot be lease, rent, distribute or sell in any condition.

TIM strongly believes in fair business and respect the property rights policy and expect the same from our members / designers / users to do the same. Any actions reflecting infringing the copyright or patent rights may result in termination of account of the user. TIM responds expeditiously to claims of infringement and process notices of alleged copyright and take strict action under the applicable laws for copyright protection worldwide.

TIM hold rights to provide your information with your name and contact as well as the information concerned to the objectionable / disputed content related to infringing of the copyright / patent of Right owner that is use and sale through the site to enable the Right owner to contact you directly to address the further procedures.

If you are a Right owner of the content / designs / materials that has been posted on the site in violation of any applicable rights or license and you want to remove the material, please contact directly to help@texindiamart.com for further procedures and we adhere to take action with the content.

TIM believe that you represent the content as complete owner of the content that you submit on the site or with us that does not infringe upon the copyright, property right, intellectual property right or any other lawful right.

You hereby indemnify us and undertake to keep us indemnified against any loss, damage, liabilities, expenses including without limitation legal expenses and any amounts paid by us to a third party settlement of a claim or dispute incurred or suffered by us arising out of any breach / violation / break of laws against these terms of use.

TIM may from time to time run promotional events or contests including surveys/ Blogs etc. You are not forced to participate in such events but with submission we get acknowledge with response / improvements / ideas time to time. Through participation, you grant TIM a worldwide, irrevocable, non-exclusive license to use, publish, translate or distribute the content for marketing purpose. Please read all conditions carefully while participating in any Promotional event or contest that may include free or purchased based participations. We offer free gifts or prize or promotional item per order.

Tex India Mart, in its sole discretion, may terminate your account including username, password, account and discard any content you have provided to the site. Tex India Mart shall not be liable to you or any third party on termination of your account or access to the site. The severe case is during breach or violation of terms of use / misconduct to proprietary rights etc.

Tex India Mart aims to serve with best of service to your orders. The designs and images uploaded to the site must be ensure that no content including text based annotations or comments are used which contain material which is pornographic, obscene, indecent or offensive that breaches applicable laws. Users / Clients are responsible for such conduct. TIM retain the right to refuse acceptance of such material in case.

• TIM follows strong procedures to ensure that product descriptions and specifications are correct. We offer color charts on desired fabric to match to your requirements of colors during actual design order using colors numbers from the chart. If you require an exact color match, please contact us prior to order and send hard copy / pantone number reference. After this, we can evaluate timeline to deliver fabric after checking color matching time procedure.
• The Pop up chat session service is available from the website in order to discuss and understand the requirements to colors / designs or any editing process to be done. However, we can assure the closest match possible and couldn’t be held responsible for any minor variations later.
• Matching to the screen option is not accurate in terms of getting color match. The color appears different on screen over Mac or Windows systems and cannot be guarantee over clear match.
• We have by post facility and walk in facility available before or after order to ease the situation for achieving right colors for your product.

We use reliable trusted third party providers to help us collect payment for orders. The Payment Gateway service provider ensures security of transaction through gateway window and there is no information entered on our website including credit card / debit card details. Pricing of products are reflected on our website incorporated into the terms by reference. All prices are for the currency of the country from where it is purchased and time of purchase. Prices may change at any point of time and it’s in TIM’s discretion

Termination of your TIM account is easy and you can do so with your account settings. Once the content from the site, it will be done permanently and no longer visible on the site. However, the contents are retained for specific period in our server / archives. If you buy any design / content and later delete from your account, we preserve a copy of the purchased content for some time.

TIM offers service for shipping on good faith and service to all clients. We do so as service with collaboration with shipping partners. The product carrying shipping cost is purely C&F and carries no liabilities of customs charges / forwarders handling cost etc. The mode of delivery in India will be through national courier by Road / Train / Air and International Orders will be delivered by Air Cargo unless specified / discussed for Sea transport separately.

In case of any failure during the term of contract or if we fail to exercise any of te rights or solutions to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance of any of your strict obligations. A waiver by TIM of any default shall not constitute a waiver of any subsequent default.

The terms of use will be governed and construed in accordance with Indian Law and any disputes related to terms will be subject to jurisdiction of Faridabad (India) Court.
